The “Photographer" means Tom Fenn of/and/or FennPhotography, 1 Bewdley Avenue, Balsall Heath, Birmingham B12 8XA. The “Client" means any person, body of persons, firm or company with whom the Photographer enters into a contract, whether via email, writing, or by contact to the Photographer’s website for the sale of goods including prints, or provision of services by the Photographer.
2. Acceptance of Terms and Conditions
The copyright of the photographs and material contained within and on this website belongs to the Photographer except where it is stated otherwise. All rights are reserved. No part of this web site may be copied or published without prior consent.
3. Payment Terms
Payments for prints are secure and are made via Stripe. We do not hold or have access to any of your personal payment details, card numbers or accounts.
By law, the Client has 14 (Fourteen) days to cancel the order for prints, however please allow up to 28 (twenty-eight) days for delivery.
On sales of photographs in which the customer receives their photographs electronically via the hosting web site: www.fennphotography.co.uk, there are no refunds. If the customer has any questions regarding this please contact me via my 'About/contact' page. All prices are given in GBP and payment can only be taken in GBP.
4. Copyright and Ownership
In accordance with the Copyright, Designs & Patents Act 1988, the copyright of all images created by the Photographer is owned by the Photographer. Unless the Photographer gives written authorisation, the Client is forbidden by law to copy any images created by the photographer and agrees that all photographic prints, reprints, digital duplications or copies of any type made from images created by the Photographer shall only be carried out by the Photographer. The licence to reproduce such images is granted to the Client on the understanding that all invoices are paid within the Photographer's stated payment terms.
5. Delivery, Loss and Damage in Transit
The Photographer will make reasonable endeavours to ensure that items delivered by a third party are suitably packaged for transit. The Photographer cannot accept liability for loss or damage caused by a third party. Delays to delivery will not be compensated for either because of delays in payment.
For valuable items such as large prints or print collections, the Client should take out suitable transit/postal insurance cover. Upon written request, the Photographer will provide suitable loss/damage cover for an additional charge.
Clients who choose to have items returned to them without loss/damage cover do so at their own risk. However prints will only be replaced or refunded once the original has been returned.
6. Prices & Terms
The Photographer reserves the right to amend both Prices and these Terms and Conditions without prior notice.
